This project looks at the use of evidence in judicial review litigation—an underdeveloped area of research which is of great importance in practice.
The project has two strands. The first, which looks broadly at facts in public law adjudication, is funded by the Australian Academy of Social Sciences and is being undertaken by Dr Joe Tomlinson with Dr Anne Carter (Deakin) and Professor Adrienne Stone (Melbourne).
The second strand of the project, drawing upon research from journalism and communication studies, focuses on how evidence may work in public law challenges to automated government systems (particularly ‘black box’ systems).
This work is being completed with the support of multiple organisations, including the Public Law Project and MedConfidential.
