Short Courses Terms and Conditions
1. Payment , cancellation & refunds
- Full programme payment must be made in advance of a delegate starting the programme
- Online payment via credit/debit card is preferred, payment by invoice incurs an additional charge of £30
- Delegates may cancel their place on the programme by emailing ldp-project@york.ac.uk – the following cancellation terms apply:
- Cancellation 14 days or more before the programme start: course fees refunded (less 10% administrative charge).
- Cancellation 7-14 days before programme start: 50% refund.
- Cancellation fewer than 7 days before programme start: no refund.
- In the event of the University of York cancelling the programme a full refund will be given, but the University of York will not accept responsibility for any additional costs incurred by the delegate (for example travel arrangements or accommodation).
- If a discount or promotional code is used by ineligible individuals or organisations, the place on the course will be cancelled, the payment refunded and the individual/organisation asked to register again with payment at full price.
- Each course requires a minimum number of delegates to be viable to deliver. If the minimum numbers are not achieved, the University of York reserves the right to cancel the course. Delegates will be notified by email with a minimum of three days’ notice and will be refunded in full via their original payment method.
- In the event of irresolvable IT issues on the part of the Course Leader that compromise the successful delivery of the session, the session will be rearranged. However, delegates will be entitled to a full refund should they not be able to attend the rearranged session.
2. Attendance
- Substitutions may be made up to two working days prior to the course start date, provided you inform us in writing (to ldp-project@york.ac.uk) and complete any registration documentation for the new delegate. No substitutions are permissible after the start of the programme.
- In the event of a delegate not attending the course online or in person, this is viewed as a cancellation without any notice.
- In the event of a delegate arriving late, without notice, to a course, the University and the Course Leader reserves the right to deny admission to the course. In the case of live online courses, the video conferencing room is usually closed ten minutes after the advertised course start time, for security purposes.
3. Live online content
- Live courses will be managed according to the individual Course Leader’s preferences and the most appropriate way to communicate the subject content and achieve the learning outcomes.
- Delegates will be sent a code of conduct before the start of the session and this will be available in the Learning Management System (LMS), also known as Administrate. Delegates are expected to read the code of conduct in advance of the session and follow the code while attending the course.
- Delegates will be informed how the session will run at the start and will be informed how to ask questions during the session.
- Course Leaders and the University administrators reserve the right to mute delegates on Zoom whilst the tutor is speaking.
- Course Leaders and the University administrators reserve the right to mute delegates on Zoom or in extreme cases remove the delegate from the course if they do not follow the code of conduct.
- Opinions expressed by delegates in a live session do not constitute the opinion of the University.
- All live courses will have the potential for delegates to pose questions, but there is no guarantee that all individual questions will be answered - if the group size and time does not allow for individual answers, the Course Leader or a University administrator will group questions into themes and the Course Leader will endeavour to address these themes within the session.
- For the avoidance of doubt, nothing in these terms and conditions shall be construed as granting to the Customer any right, title, or interest in any of the intellectual property rights of the University of York.
4. Liability
- The LMS is provided to you “as is” and we exclude all representations, warranties, conditions and terms expressly or implied by statute, common law or otherwise to the fullest extent permitted by law. We do not guarantee that:
- use of the LMS or Zoom will be compatible with all hardware and software,
- use of the LMS or Zoom will be uninterrupted or error or virus free,
- use of the LMS or Zoom will deliver any specific outcome for its users, or
- defects on the LMS or Zoom will be corrected (save for those defects which the University of York is obliged to correct by law).
- You must take appropriate steps to ensure that you regularly check for and protect against viruses when using the LMS or Zoom on any device.
- We may terminate your account or your access to/use of the LMS with immediate effect
- if we reasonably believe you are in breach of these terms and conditions and/or the code of conduct;
- in order to prevent any abusive, fraudulent or unlawful activity;
- where necessary to prevent or stop any harm or damage to the university, any learner or the general public.
- To the fullest extent permitted by law, the aggregate liability of the University of York, to you, the Customer, to under or in relation to these terms and conditions shall be limited to the total price payable by you under these terms and conditions.
- Nothing in these terms and conditions shall exclude or limit liability for negligence resulting in personal injury or death; fraud; or for any other type of liability that, by law, cannot be limited or excluded.
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the jurisdiction of the courts of England and Wales.
